Appeals from citizens and legal entities

In accordance with part one of paragraph 1 of Article 25 of the Law of the Republic of Belarus dated July 18, 2011 No. 300-3 «About appeals of citizens and legal entities» (further- Law) electronic applications received by state bodies and other state organizations are subject to consideration in the manner prescribed for the consideration of written applications, taking into account the specifics provided for in this article. 

Electronic applications must comply with the requirements established by clause 1, paragraphs two to four of clause 2 or paragraphs two to five of clause 3 of Article 12 of the Law.

In particular, the general requirement for applications from citizens and legal entities is the presentation of the application in Belarusian or Russian.

Electronic applications of citizens should contain:

name and (or) address of the organization or position of the person to whom the appeal is sent;

last name, first name, patronymic (if any) or initials of the citizen, address of his place of residence (place of stay) and (or) place of work (study);

applicant's email address;

electronic applications submitted by representatives of applicants must be accompanied by electronic copies of documents confirming their authority;

electronic applications submitted by representatives of applicants must be accompanied by electronic copies of documents confirming their authority.

Electronic applications of legal entities must contain:

name and (or) address of the organization or position of the person to whom the appeal is sent;

full name of the legal entity and its location;

surname, first name, patronymic (if any) of the head or the person authorized in the prescribed manner to sign the appeal;

electronic applications submitted by representatives of applicants must be accompanied by electronic copies of documents confirming their authority;

applicant's email address;

statement of the essence of the appeal.

Are left without consideration of the merits of the appeal, which (for which):            

are not presented in Belarusian or Russian;

do not contain the last name, proper name, patronymic, address of the place of residence (place of stay) of the citizen; do not contain the full name of the legal entity and the address of its location, surname, proper name, patronymic of the head or the person authorized in the prescribed manner to sign applications (for legal entities );

do not contain the applicant's email address;

do not contain electronic copies of documents confirming the powers of the representative of the applicant who submitted the electronic appeal;

contain text that cannot be read;

contain obscene or offensive words or expressions;

are subject to consideration in accordance with the legislation on constitutional proceedings, civil, civil procedural, economic procedural, criminal procedural legislation, legislation that determines the procedure for the administrative process, legislation on administrative procedures, or in accordance with legislative acts, a different procedure for filing and considering such appeals is established;

contain issues that are not within the competence of the State Military-Industrial Committee of the Republic of Belarus;

missed the deadline for filing a complaint without good reason;

a repeated appeal is filed if it has already been considered on the merits and it does not contain new circumstances that are important for the consideration of the appeal on the merits;

correspondence with the applicant has been terminated.

Revocation of an electronic appeal

In accordance with Article 16 of the Law of the Republic of Belarus of 18.07.2011 No. 300-3 "On Appeals of Citizens and Legal Entities", the applicant has the right to withdraw his appeal before considering it on the merits by submitting a written application or sending an application in electronic form.

Responses to e-mails, as well as notifications of applicants about leaving their electronic applications without consideration on the merits, about sending electronic applications for consideration to organizations in accordance with their competence, terminating correspondence, extending the period for considering applications are sent to the applicants' e-mail address specified in electronic applications. At the same time, written responses (written notifications) may be given to electronic applications in the following cases: if the applicant in his electronic application asks for a written response (written notification); the e-mail does not contain an e-mail address; in the case when the decision to send a written response (written notification) was made by the head of a state body or other state organization considering electronic applications, or by a person authorized by him.

Appealing responses to appeals

In accordance with Article 16 of the Law of the Republic of Belarus dated July 18, 2011 No. 300-3 "On Appeals of Citizens and Legal Entities", the organization's response to the appeal or the decision to leave the appeal without consideration on the merits can be appealed to parent organization. 

The superior organization, upon receipt of such a complaint, checks the information contained in it and, if there are grounds for a positive solution to the issues set out in the appeal, it considers the appeal on the merits or issues a binding order to the relevant organizations that considered the appeal on the merits of the proper resolution of these issues, which notifies the applicant ... An organization that received such an order must fulfill it within the time period specified in the order, but no later than one month and within three working days inform the parent organization about it, and also send a response to the applicant.

The organization's response to the appeal or the decision to leave the appeal without consideration on the merits after appeal to a higher organization may be appealed to the court in the manner prescribed by law.
